As Christmas approaches and Santa, Rudolph and all the Elf’s start their busiest weekend of the year; We started thinking of those who might not be getting a present in the digital world and why. We’ve come up with a few groups who might not have presents under the Christmas tree on the 25th:
1 – Those who haven’t written a list and checked it twice
A key message of both the Civil Procedure Rules and the Attorney General’s Guidelines on Disclosure, is that proportionality needs to be considered as part of any modern day investigation or litigation. As the tools at our disposal are pretty much limitless in terms of functionality, it is important to know what you need to achieve, and have the parameters agreed early in the case. Agreeing the budgets (Precedent H), EDQ, keywords and scope early, will allow you to control the case and make sure it proceeds as planned. It is very difficult to do this without prior input for your ED provider.
2 – Those who don’t know where Santa lives or how he travels
Knowing where data is and how it moves around will be crucial in 2017; especially as the world becomes a more global community, and as we draw closer to GDPR coming into force in 2018. Data collections are often an upfront and costly process, knowing how to streamline approaches whilst doing it in a safe and proportionate manner will control the costs. One of the biggest changes to the recently updated US regulations (FRCP) is, that missing data is as bad as deliberately deleting it. As the data we collect becomes more volatile, it will become crucial to ensure collections are done safely using best practice procedures.
3 – Santa’s checked if you’ve been naughty or nice
ED tools enable us to run quick automation processes, to understand if users have data they shouldn’t have, (such as credit card numbers) or have been communicating with people they shouldn’t have (such as competitors or fraudsters). It is becoming increasingly more important to know who did what, and our processes allows investigators to track back to the original source data.
4 – If you don’t believe in Santa and all of the team
The ED market has been growing exponentially in the last few years along with its capabilities. Making sure you’re using up to date, market leading tools, will allow you to stay one step ahead. Extracting new data sources from the social media and the cloud, or using more advanced search functionalities, such as, concept searching, or using ‘Technology Assisted Review’ and ‘Predictive Coding’.
5 – Being fooled by a fake Santa
In the news we see an increasing number of global businesses who have experienced massive data breaches; they’ve even made a film about one of them. Making sure that the providers you use treat your data with the upmost care is critical.
6 – Those who haven’t been prepared
Pre-mediation is now essential to understand the value of your case. If you have not done any testing, you will be blind folded when agreeing the scope and parameters of the case.
